Agreement and Applicability

Each order constitutes acceptance by the consumer of our general terms and conditions, which are an integral part of the agreement.

Prices and payments
Prices of goods are indicated in euros and include VAT. Shipping costs are not included, unless stated otherwise. The consumer pays the price when placing the order. The shipment will only take place when we have received the payment.
The consumer makes his payments by means of wix payment, klarna, ideal, bank contact or via bank transfer.
Unless otherwise agreed, the amounts owed by the consumer must be paid within 5 working days after placing the order.
Orders are reserved for 5 days pending payment. If payment is made after that term, the order will automatically expire.
Our offer
The offer contains a description of the products offered. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer.
If Create a bra uses images, these are the best possible representation of the products offered. There is a possibility that colors may appear slightly different from PC screen to PC screen. Obvious mistakes or errors in the offer are not binding on the entrepreneur.
Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer.
This concerns in particular: the delivery, price and payments, whether or not the right of withdrawal is applicable, the method of payment, delivery and execution of the agreement.
Right of withdrawal
The consumer has the right to withdraw from the agreement within a period of 14 days without stating reasons. It is not allowed to try on the product or to remove it from the original packaging. As a result, the right of withdrawal expires.
The withdrawal period expires 14 days after the day on which you, or a third party designated by you other than the carrier, took possession of the product.
The goods are returned at the risk and expense of the consumer to Create a bra, Korenbloemstraat 14, 3660 Oudsbergen.
To make use of your right of withdrawal, please contact us via contact. If you make use of this option, we will immediately send you a confirmation of receipt by e-mail. You must return the products within 14 days after sending the model form.
In the event of a withdrawal, you will receive payment as soon as possible and no later than 14 days after we have received the goods. Payments are made by bank transfer to your bank account.
Exclusion right of withdrawal
The consumer cannot invoke his or her right of withdrawal if:

The delivered products were made to measure according to the consumer's instructions.
The delivered products are incomplete, soiled or broken.
The delivered products are not in the original packaging.
In case of excessive returns of orders by the consumer, Create a bra reserves the right to refuse future orders.
Complaints and warranty
All complaints in connection with the delivered products must be reported in writing, under penalty of forfeiture, by means of a registered letter within 8 calendar days after delivery. Any defect that has not been reported in time will invalidate any right to repair or replacement.
Defects caused by accidents, negligence or misuse (by the consumer or by third parties) are not covered by the warranty.

Force of the majority
The entrepreneur is not liable for a delay in the performance or for a non-performance of our commitment due to events beyond its normal control, including production interruptions, difficulties in supply or shortages of raw materials, manpower, energy or transport or delays in transport, strikes , lockouts, work stoppages or other collective labor disputes, affecting either ourselves or our suppliers, even if these events are foreseeable.
Applicable law
All agreements concluded with Create a bra are governed by Belgian law alone.
The Belgian courts have exclusive jurisdiction.
Terms of delivery
Orders of goods are carefully packed and sent via B-post.
The consumer chooses to have the goods delivered to the address specified during the ordering process.
The place of delivery is the address that the consumer has made known to the entrepreneur.
Incorrect delivery addresses are the responsibility of the consumer and may lead to additional costs.
Products are only delivered to countries for which the website allows delivery.
The ordered products will be delivered as soon as possible and in any case within a period of 30 calendar days. This from the date of receipt of the e-mail confirmation.
Create a bra only delivers when full payment of the order has been received.
If it is not possible to deliver the goods within the specified period, Create a bra must inform the buyer of this in writing.
Create a bra is not liable for any damage, delays by B-post or loss during shipment.
Our packages are always sent insured and can be tracked via the tracking data.
